Kenya Grants GATES Foundation Diplomatic IMMUNITY

… to confer special status on the foundation

… beneficiary of section 11 of the Privileges and Immunities Act

… the foundation will now have the capacity to:

“(a) enter into contracts

(b) institute and defend legal proceedings;

(c) acquire, hold or dispose of movable and immovable property”    [ Legal notice 157 ]

… the foundation will be granted the privileges and immunities outlined in paragraphs 3 and 4 of Part I of the Fourth Schedule to the Act  [ Legal notice 157 ]

… the director, officials, and staff of the foundation, while residing in Kenya

… will receive the privileges and immunities listed in paragraphs 1, 2, 3, 4, 5, 6, and 7 of Part III of the Fourth Schedule to the Act:

  • Immunity from legal action for acts done in the course of official duties
  • Exemption from direct taxes on their salaries

  • Exemption from national service obligations
  • Immunity from immigration restrictions and alien registration for themselves, their spouses, and dependents.

  • Privileges similar to those of diplomatic officials regarding exchange control facilities.

  • Repatriation facilities during international crises, similar to those granted to diplomatic missions.

  • Exemption from taxes or duties on importing personal belongings when first arriving to assume their role in Kenya.  [ Privileges and Immunities Act, p. 35-36 ]
